Jurisdictional Error: Court Options for Migration Applicants (Cat B)
Course Code: MLT2500 – Duration: 1.5 hours – Eligible for 1 OMARA Cat B point (SM510)
If an applicant receives a negative decision from the AAT, they may have the opportunity to have that decision reversed by the Federal Circuit Court. This course explains the legal concept of jurisdictional error (JE) and provides RMAs with a framework to examine AAT decisions and identify what may be instances of jurisdictional error that can be used by applicants in court proceedings. Includes detailed case studies and examples in PDF format.
